The New York State Office for People With Developmental Disabilities (OPWDD) is responsible for coordinating services for New Yorkers with developmental disabilities, including intellectual disabilities.
OPWDD determines whether a person has a developmental disability and meets all the conditions of eligibility for OPWDD-funded services. The family will need to provide evidence (such as reports of assessments and evaluations conducted by medical professionals) that their child has a developmental disability, enroll in Medicaid, and apply for Medicaid Waiver.
In order for a person to be eligible for OPWDD services, New York State Mental Hygiene Law requires:
1. The presence of a developmental disability that is described by certain qualifying diagnoses or conditions,
2. The disability occurred before the person reached age 22,
3. The disability can be expected to continue indefinitely or permanently, and
4. The disability causes a substantial handicap to a person’s ability to function normally in society

If your child is currently in a public school setting and is struggling, you can and probably should seek to place your child in a more suitable private setting and give him/her an opportunity to thrive. Almost all the special needs schools work with parents and do not require tuition payments (which can be over $60K per year) as long as the parents are working with a special needs attorney in suing the DOE for such tuition reimbursement.
